Reason for Discharge: Worn out unfit for active military Duty. Character & Conduct Has been good, in possession of 4 Good Conduct badges. Garrison Court Martials: 1. 8 January 1832 for disgraceful conduct for having on or about 11 December 1837 absence without leave from the Government hospital whilst under medical treatment the same being in breach of the Articles of War. 2. For deserting from the Regimental guard room on the morning of 12th December 1837 whilst confined as a prisoner on the first offence. 3.Of having lost or made away with various articles of his Regimental necessities e.g. clothing Convicted sentenced to 3 calendar months imprisonment, the first week of each month in solitary confinement, the remainder in hard labour and to branded with the letter D and to be put under stoppages not exceeding 2/3 of his daily pay until the amount owing for the necessities is made good. On 17th December 1870 Margaret Cody directed Jane McIntyre the wife of pensioner Daniel McIntyre to write a letter to Mr Bateman authorising her (Margaret Cody) to be paid £2 due to her daughter Catherine Thompson’s husband, a seaman on one of Bateman’s ships as she was unable to collect it herself. 20th December 1870 Margaret Cody was charged with having feloniously forged an order for the payment of money from J & W Bateman. However events overtook when Margaret was arrested for murder. He was shot by the police at Esperance. Research showed a strange colonial background with his mother hung for murder in the old Perth gaol. A long forgotten but interesting story.” This book is the basis of Catherine Cody’s marriage to James Thompson and for James Cody being part of the Cody Family.
