He voluntarily signed an agreement that he was willing to serve permanently in North America when he transferred from 34th regiment to the 8th regiment on 31st May 1841 British Army Worldwide index 1841 James Smith, 1134, Private 34th regiment, date 1st June 1841 to 8th Foot, location Toronto and at sea. Canada. Discharge due to having lost the teeth in his upper jaw he was unable to bite cartridges 1853 Maryann Smith signed testimonial for the surgeon on the Robert Small 1st November 1868 when James was admitted to Chelsea hospital it said that his wife had no family and was able to maintain herself: Address 87 Chapel Street Blackburn Lancashire England.
