He bequeathed his entire estate for the benefit of his wife providing she did not remarry and then it would be divided between the children of the marriage.

Mary Munday bequeathed to her children James Henry Munday, Mary Ann Fenner and Catherine Acton a third (approx.) share of Fremantle Town Location 467 situated between High and Ellen Streets Fremantle. She furthermore bequeathed £300 to each of her sons William and Edward. To her son Frederick his wife and family she left £300 to be paid for the maintenance, education, support or benefit at the absolute and uncontrolled discretion of the Trustees. The total value of the estate was £1910/11/0 of which £900 was the value of the land and £1010/11/0 was cash.
