During the voyage of the Robert Small, Edward Bateman made allegations against the Surgeon Superintendent and Sergeant Major Knox. Despite the Surgeon Superintendent trying to get Bateman and McQuade off the ship at Rio de Janeiro they continued as part of the guard to Fremantle. After the ship arrived in Fremantle an Inquiry was held that exonerated Mc Quade followed by a Court martial where Bateman was acquitted of all charges.
